Immigration and Work Permits

In General —
All foreign workers need a visa and a work permit to work in France unless they are nationals of one of the member states of the European Union.
An employer in France that wishes to hire a foreign worker must draft an employment contract and submit it to the local labor office with a petition for employment.

所有外國工人都需要簽證和工作許可證才能在法國工作,除非他們是歐盟成員國之一的國民
法國雇主如希望僱用外國工人,必須起草一份僱傭合同,並將其與就業申請一起提交給當地的勞工辦公室。

Visas and Work Permits —
All foreign workers need a visa and a work permit to work in France unless they are nationals of one of the member states of the European Union.
Several types of work permits are available, depending on the applicant’s position.

所有外國工人都需要簽證和工作許可證才能在法國工作,除非他們是歐盟成員國之一的國民
根據申請人的職位,可以使用多種類型的工作許可證。

The employee-on-assignment permit員工外派許可證

The employee-on-assignment permit allows non-EU nationals who have an employment contract with a company based outside the EU to transfer to one of their company’s branches in France.
The applicant must have been employed by the company outside France for at least three months and received a salary of at least 1.8 times the minimum wage in France.
員工外派許可證,允許與歐盟以外的公司簽訂僱傭合同的非歐盟國民,轉移到其公司在法國的分支機構之一。
申請人必須在法國以外的公司受僱至少三個月,並且獲得的工資至少是法國最低工資的1.8倍。
The permit is valid for three years, after which the employee must apply for a new permit.
Family members may accompany workers on employee-on-assignment permits.

The EU Blue Card歐盟藍卡
The EU Blue Card is a work permit intended to permit highly educated non-EU citizens to work and live in the EU.
The card is intended to be equivalent to the U.S. green card and encourages long-term residency in an EU country.
歐盟藍卡是一種工作許可證,旨在允許受過高等教育的非歐盟公民在歐盟工作和生活。
該卡旨在等同於美國綠卡,並鼓勵在歐盟國家長期居住。

To qualify for a Blue Card, the worker must have:
• a diploma representing at least three years of higher education issued by an
institution recognized by the country in which it is located or five years of
professional experience at a comparable level,
• an employment contract for a period equal to or greater than one year, and
• an annual salary of at least 1.5 times the gross annual reference salary.
要獲得歐盟藍卡資格,工人必須具備:
• 由所在國家/地區認可的機構頒發的至少三年高等教育的文憑,或具有同等水平的五年專業經驗,
• 一年或一年以上的僱傭合同,以及

The salaried temporary permit受薪臨時許可證

The salaried temporary permit is for non-EU nationals who will be working on a project in France lasting one year or more.
The temporary work permit is for those who will be working in the country less than one year.
In both cases, the prospective French employer must prove that it was unable to find a qualified French candidate that was available for the job.

受薪臨時許可證,適用於將在法國從事為期一年或更長時間的項目的非歐盟國民。
臨時工人許可證,適用於將在該國工作不到一年的人。
在這兩種情況下,未來的法國雇主必須證明它無法找到適合該工作的合格法國候選人。

The skills and talent visa技能和人才簽證
The skills and talent visa is available to individuals who have the potential to make a “significant contribution” to the French economy, especially in intellectual, scientific, cultural, sporting, or humanitarian fields.
The visa, which generally is geared toward the completion of a specific project, is valid for a period of up to four years.
技能和人才簽證適用於有潛力為法國經濟做出“重大貢獻”的個人,尤其是在知識、科學、文化、體育或人道主義領域。
簽證通常用於完成特定項目,有效期最長為四年。

Accompanying family members automatically receive a permit to reside and work in France.
The scientific permit allows individuals holding at least a Master’s degree to enter France to carry out research and other academic work.
Academic residents are not allowed to take up paid employment outside their research or teaching assignments.
隨行的家庭成員自動獲得在法國居住和工作的許可證。
科學許可證允許至少持有碩士學位的個人進入法國從事研究和其他學術工作。
學術居民不得從事研究或教學任務之外的帶薪工作。

Penalties —
Failure to comply with the legal requirements governing the introduction of foreign workers to France may give rise to various sanctions including criminal liabilities.
Courts will impose fines and imprisonment upon the employer (up to 10 years in prison and a fine of 100,000 euros for individuals and 500,000 euros for legal entities), while French authorities can withhold the employee’s authorization to work or stay in France.
Additional criminal or administrative sanctions are available, such as confiscation of all or part of the employer’s assets, exclusion from public procurement and dissolution.

不遵守將外國工人引入法國的法律要求可能會導致各種制裁,包括刑事責任。
法院將對雇主處以罰款和監禁(最高 10 年監禁,個人罰款 100,000 歐元,法人實體罰款 500,000 歐元),而法國當局可以扣留僱員在法國工作或逗留的許可。
